These terms govern your use of ImageMerger ("the Service"), operated by ImageMerger.io ("we", "our", or "us"). By using our Service, you agree to these terms.

1. The Service

ImageMerger provides AI-powered product image generation for ecommerce sellers. You upload product images, and our service generates background variations suitable for marketplace listings.

2. Account Registration

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use the Service
• One account per person; accounts are non-transferable

3. Credits and Payment

Credit System

• The Service operates on a credit-based system
• Each image generation consumes 2 credits
• Credits are purchased in packages and do not expire
• Credit balances are non-transferable between accounts

Pricing

• Prices are displayed in your selected currency
• All prices include applicable taxes unless stated otherwise
• We reserve the right to change prices with reasonable notice

Payment Processing

Payments are processed securely by Stripe. By making a purchase, you also agree to Stripe's terms of service.

4. Refunds and Cancellation

Your Right to Cancel (14-Day Cooling-Off Period)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your purchase within 14 days without giving any reason. The cancellation period expires 14 days from the day of purchase.

How to Cancel

To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., email to support@imagemerger.io). You may use the following cancellation form, but it is not obligatory:

Important: Digital Content Exception

When you use credits to generate images, you expressly consent to immediate performance of the service and acknowledge that you will lose your right to cancel once the generation process begins.

At checkout, you will be asked to:

1. Expressly consent to the immediate supply of digital content
2. Acknowledge that you will lose your cancellation right once generation begins

If you have not used any credits and wish to cancel within 14 days, you are entitled to a full refund.

Refunds for Unused Credits

If you cancel within 14 days and have not used any credits, we will refund you within 14 days of receiving your cancellation notice using the same payment method you used for the original purchase.

For partially used credit packages, we may offer a pro-rata refund at our discretion for the unused portion. Contact us at support@imagemerger.io.

Service Issues

If our service fails to generate images due to a technical error on our side, the credits will be refunded to your account balance.

5. Acceptable Use

You agree not to:

• Upload illegal, harmful, or offensive content
• Upload images you don't have rights to use
• Use the Service to infringe intellectual property rights
• Attempt to reverse-engineer or exploit the Service
• Use automated tools to access the Service without permission
• Resell access to the Service without authorisation
• Upload images containing personal data of others without consent

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Content

Uploaded Images

• You retain ownership of images you upload
• You grant us a license to process your images to provide the Service
• Uploaded images are temporarily stored and deleted within 24 hours

Generated Images

• You own the generated images and can use them commercially
• Generated images are stored in your account until you delete them
• We do not claim ownership of generated images, but we may use anonymised, aggregated data to improve our AI models

7. Intellectual Property

• The Service, including our AI models and website, is our intellectual property
• You may not copy, modify, or distribute our software or technology
• "ImageMerger" and our logo are our trademarks

8. Service Availability

• We aim to provide reliable service but do not guarantee 100% uptime
• We may perform maintenance that temporarily affects availability
• We are not liable for losses caused by service interruptions

9. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for losses arising from your use of generated images

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify us against claims arising from your breach of these terms, your content, or your violation of any third-party rights.

11. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes by email or by posting a notice on our website. Continued use of the Service after changes constitutes acceptance.

12. Termination

• You may close your account at any time
• We may suspend or terminate accounts that violate these terms
• Upon termination, your right to use the Service ends
• Unused credits are generally forfeited upon termination for cause

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the laws of your country of residence that cannot be waived.

14. Consumer Rights

If you are a consumer in the UK or EU, you have statutory rights under consumer protection laws. Nothing in these terms affects those rights.

15. Dispute Resolution

If you have a complaint, please contact us first at support@imagemerger.io. We will try to resolve any issues directly with you.

EU/UK consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/odr

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and ImageMerger regarding the Service.
